1. About these Terms

These Terms of Service ("Terms") govern your access to and use of the Boston Dogtor client portal and any related web or mobile application (together, the "Portal") operated by Boston Dogtor LLC, a Massachusetts limited liability company located at 89 Turnpike Road, Southborough, MA 01772 ("Boston Dogtor," "we," "us," or "our"). By creating an account, checking the box to accept these Terms, or otherwise using the Portal, you agree to these Terms. If you do not agree, do not use the Portal.

2. Relationship to other agreements

Your use of the Portal is also governed by the following documents, each of which is incorporated into these Terms by reference:

Waiver and Release of Liability. Our boarding, daycare, training, and all in-person services (the "Services") are governed by the separate Boston Dogtor LLC Waiver and Release of Liability that you sign before participating. That document, not these Terms, controls all matters relating to physical risk, the care and handling of dogs, injury, illness, veterinary care, and related liability.

Privacy Policy. Our handling of your personal information is described in our Privacy Policy.

These Terms cover your use of the Portal software. The Waiver and Release of Liability is the controlling agreement: in the event of any conflict or inconsistency between the Waiver and any other document — including these Terms of Service or the Privacy Policy — the terms of the Waiver and Release of Liability govern and supersede.

3. Eligibility

You must be at least 18 years of age and able to form a binding contract to create an account or use the Portal. The Portal is intended for our clients and prospective clients in connection with the Services.

4. Your account

You are responsible for the information you provide and for maintaining the confidentiality of your login credentials. You agree to provide accurate, current information (including your dog's health and vaccination details) and to keep it updated. You are responsible for activity that occurs under your account. Notify us promptly at [contact email] if you believe your account has been accessed without authorization at bostondogtor@gmail.com.

5. Bookings and the Services

The Portal lets you request appointments (such as Overnight Boarding, Doggy Daycare, and Training), upload records, message our staff, and view your account. A request submitted through the Portal is a request only; it is not confirmed until we accept it, and acceptance may depend on availability, capacity, and your dog's eligibility. We may decline, reschedule, or cancel a booking consistent with our policies and the Waiver.

6. Pricing, deposits, and payments

Current prices for the Services are shown in the Portal or provided to you and may change from time to time. Some bookings require a deposit submitted through the Portal. You agree to pay all amounts due for Services you book. Cancellation, deposit, and refund terms are as communicated to you at booking and in any applicable agreement or refund agreement you sign. Where we offer electronic card or third-party payment options (for example, through a payment processor), those payments are also subject to that processor's terms, and we do not store full payment card numbers ourselves.

7. Acceptable use

You agree not to: (a) access or attempt to access another user's account or data; (b) interfere with, probe, or disrupt the Portal or its security; (c) upload malicious code or content that is unlawful, infringing, or harmful; (d) use the Portal to send spam or harass others; or (e) copy, scrape, reverse engineer, or resell any part of the Portal except as allowed by law. We may suspend or terminate access for conduct that violates these Terms.

8. Electronic communications

By using the Portal, you consent to receive communications from us electronically, including transactional and service messages (such as booking confirmations, account notices, and messages from our staff) by email and through the Portal. We send these from our Boston Dogtor email address. Marketing emails, if any, will include an unsubscribe option; opting out of marketing does not stop transactional or service messages necessary to provide the Services.

9. Your content and intellectual property

You retain ownership of the information, records, and photos you upload ("Your Content"), and you grant us permission to use Your Content as needed to provide the Services and operate the Portal. The Portal itself, including its software, design, and text, is owned by Boston Dogtor or its licensors and is protected by applicable law. We grant you a limited, revocable, non-transferable right to use the Portal for its intended purpose.

10. Third-party services

The Portal relies on third-party providers (for example, our website host, email delivery, and any payment processor). We are not responsible for the acts or omissions of these providers, and your use of their services may be subject to their own terms.

11. Disclaimers

The Portal is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of any kind regarding the Portal software, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Portal will be uninterrupted or error-free. This Section concerns the Portal software only. It does not limit, replace, or affect the Waiver and Release of Liability, which governs the Services and all physical risk.

12. Limitation of liability

To the fullest extent permitted by law, and except for matters governed by the Waiver, Boston Dogtor will not be liable for indirect, incidental, special, or consequential damages arising out of your use of the Portal, and our total liability relating to the Portal software will not exceed the amounts you paid to us for Services in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms is intended to limit any liability that cannot be limited under Massachusetts or federal law.

13. Indemnification

You agree to indemnify and hold harmless Boston Dogtor from claims and expenses arising out of your misuse of the Portal or your violation of these Terms, to the extent permitted by law.

14. Suspension and termination

You may stop using the Portal at any time. We may suspend or terminate your access if you violate these Terms or to protect the Portal, our staff, clients, or animals. Provisions that by their nature should survive termination (such as Sections 9–13 and 15) will survive.

15. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Subject to the Waiver, you agree that disputes relating to the Portal will be brought in the state or federal courts located in Massachusetts.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you through the Portal or by email. Your continued use of the Portal after changes take effect means you accept the updated Terms.

17. Entire agreement; order of precedence; severability

These Terms, together with the Waiver and Release of Liability and the Privacy Policy, are the entire agreement between you and Boston Dogtor regarding the Portal and the Services. If any conflict or inconsistency exists among these documents, they control in the following order of precedence: (1) the Waiver and Release of Liability; (2) these Terms of Service; (3) the Privacy Policy. If any provision is found unenforceable, the remaining provisions stay in effect.
